FLORIDA DEATH PENALTY DECISION

A recent Florida Supreme Court decision giving judges more discretion on who receives the death penalty may affect a local death row inmate.  The decision could affect the sentence of Leonard Gonzalez Jr. who was convicted for the 2009 deaths of Escambia County residents Byrd and Melanie Billings. He was sentenced to death in 2011. Gonzalez is one of many death row inmates around the state who successfully petitioned for a resentencing hearing, which is scheduled for November and will be a mini-trial where jurors vote for life or death. However, prosecutors believe the new Supreme Court ruling gives a judge the authority to sentence Gonzalez without the need for a jury recommendation.
